CONSTITUTION
OF THE PRIDNESTROVIAN MOLDAVIAN REPUBLIC

Article 76-1

1. Executive power in the Pridnestrovian Moldavian Republic shall be exercised by the Government of the Pridnestrovian Moldavian Republic.

2. The Government of the Pridnestrovian Moldavian Republic shall consist of the Chairman of the Government of the Pridnestrovian Moldavian Republic, deputy chairmen of the Government of the Pridnestrovian Moldavian Republic, ministers, heads of state administrations of cities and regions.

3. Members of the Government cannot hold any other paid position, carry out entrepreneurial and other activities, with the exception of scientific, teaching and other creative activities, be a deputy of the Supreme Council and other representative bodies in the Pridnestrovian Moldavian Republic and also suspend membership in political parties and other public associations pursuing political goals for the entire term of their powers.

Legislative acts of the Pridnestrovian Moldavian Republic may establish other types of activities incompatible with the status of members of the Government.

Article 76-2

1. The Chairman of the Government of the Pridnestrovian Moldavian Republic shall be appointed by the President of the Pridnestrovian Moldavian Republic with the consent of the Supreme Council.

2. Nominations for the Chairman of the Government of the Pridnestrovian Moldavian Republic shall be submitted not later than two weeks after the newly elected President of the Pridnestrovian Moldavian Republic assumes office or after the resignation of the Government of the Pridnestrovian Moldavian Republic or within two weeks after the Supreme Council has rejected the nomination.

3. The Supreme Council shall consider the candidate nominated by the President of the Pridnestrovian Moldavian Republic for the post of Chairman of the Government of the Pridnestrovian Moldavian Republic within one week after the submission of the nomination.

The President of the Pridnestrovian Moldavian Republic shall have the right to nominate the same candidate for the post of Chairman of the Government of the Pridnestrovian Moldavian Republic no more than two times.

4. In the event that the Supreme Council rejects the candidates for the post of Chairman of the Government of the Pridnestrovian Moldavian Republic by the Supreme Council three times, the President of the Pridnestrovian Moldavian Republic shall appoint the Chairman of the Government of the Pridnestrovian Moldavian Republic, dissolve the Supreme Council, with the exception of cases provided for by paragraphs 3, 4 of Article 76 of the Constitution.

Article 76-3

1. The Chairman of the Government of the Pridnestrovian Moldavian Republic shall, not later than one week after appointment, submit to the President of the Pridnestrovian Moldavian Republic proposals on the structure of executive government offices.

2. The Chairman of the Government of the Pridnestrovian Moldavian Republic shall propose to the President of the Pridnestrovian Moldavian Republic candidates for the posts of deputy chairmen of the Government of the Pridnestrovian Moldavian Republic, ministers, heads of state administrations of cities and regions.

Article 76-4

The Chairman of the Government of the Pridnestrovian Moldavian Republic, in accordance with the Constitution of the Pridnestrovian Moldavian Republic, laws, edicts of the President of the Pridnestrovian Moldavian Republic shall determine the basic objectives of the activities of the executive bodies of state power and the Government of the Pridnestrovian Moldavian Republic and shall organize the work of the Government of the Pridnestrovian Moldavian Republic.

Article 76-5

1. The Government of the Pridnestrovian Moldavian Republic:

a) shall  develop and submit to the Supreme Soviet a republican budget and provide for its implementation; shall submit to the Supreme Council a report on the implementation of the republican budget; and shall submit to the Supreme Soviet annual reports on the results of its work, including on issues raised by the Supreme Soviet;

b) shall ensure the implementation in the Pridnestrovian Moldavian Republic of a uniform financial, economic, credit and monetary policy in the Pridnestrovian Moldavian Republic;

c) shall ensure the implementation in the Pridnestrovian Moldavian Republic of a unified State policy in the sphere of culture, science, education, physical culture and sports, health care, social security, ecology;

d) shall carry out the administration of state property;

e) shall carry out measures to secure the defense of the country, State security, and implementation of the foreign policy of the Pridnestrovian Moldavian Republic;

f) shall take measures to ensure the foundations of customs regulation;

g) shall take measures to ensure the rule of law, the rights and freedoms of citizens, the protection of property and public order, the fight against crime;

h) exercise other powers assigned to him by the Constitution of the Pridnestrovian Moldavian Republic, laws, decrees of the President of the Pridnestrovian Moldavian Republic.

2. The procedure of activity of the Government of the Pridnestrovian Moldavian Republic shall be determined by the constitutional law.

Article 76-6

1. On the basis of the Constitution of the Pridnestrovian Moldavian Republic, laws, normative edicts of the President of the Pridnestrovian Moldavian Republic and for the purpose of their implementation, the Government of the Pridnestrovian Moldavian Republic shall  issue decrees and  regulations and ensure their implementation.

2. Decrees and regulations of the Government of the Pridnestrovian Moldavian Republic shall be binding on the entire territory of the Pridnestrovian Moldavian Republic.

3. In the event that decrees and regulations of the Government of the Pridnestrovian Moldavian Republic conflict with the Constitution of the Pridnestrovian Moldavian Republic, laws and edicts of the President of the Pridnestrovian Moldavian Republic, they may be abolished by the President of the Pridnestrovian Moldavian Republic.

Article 76-7

The Government of the Pridnestrovian Moldavian Republic shall resign its powers before a newly-elected President of the Pridnestrovian Moldavian Republic.

Article 76-8

1. The Government of the Pridnestrovian Moldavian Republic may offer its resignation and the President of the Pridnestrovian Moldavian Republic shall either accept or reject it.

2. The President of the Pridnestrovian Moldavian Republic may decide on the resignation the Government of the Pridnestrovian Moldavian Republic.

3. The Supreme Council may express no confidence in the Government of the Pridnestrovian Moldavian Republic. A resolution of no confidence in the Government shall be adopted by a two-thirds majority of the total number of deputies of the Supreme Soviet established by the Constitution. After the Supreme Council has expressed no confidence in the Government of the Pridnestrovian Moldavian Republic, the President of the Pridnestrovian Moldavian Republic shall have the right to announce  the resignation of the Government of the Pridnestrovian Moldavian Republic,  to reject the decision of the Supreme Council. In the event that the Supreme Council, within three months, re-expresses no confidence in the Government of the Pridnestrovian Moldavian Republic, the President of the Pridnestrovian Moldavian Republic shall announce the resignation of the Government or dissolves the Supreme Council.

4. In the event of the resignation or cessation of the powers of the Government of the Pridnestrovian Moldavian Republic, it shall continue to work on the instructions of the President of the Russian Federation until a new Government of the Russian Federation is formed.
