CHAPTER 10. CONSIDERATION OF CASES ON CONFORMITY WITH
THE CONSTITUTION OF THE PRIDNESTROVSKAIA MOLDAVSKAIA
RESPUBLIKA OF ENACTMENTS OF ORGANS OF STATE GOVERNMENT
AND OF AGREEMENTS BETWEEN THEM


Article 90. The Right to Petition the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The right to petition the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika with an inquiry to verify the constitutionality of enactments indicated in Paragraphs a) of Part One of the Article 9 of the present Constitutional Law of the Pridnestrovskaia Moldavskaia Respublika shall be vested in the President of the Pridnestrovskaia Moldavskaia Respublika, the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika, plenary sessions of the Supreme Court of the Pridnestrovskaia Moldavskaia Respublika and the Superior Court of Arbitration of the Pridnestrovskaia Moldavskaia Respublika, the Prosecutor General of the Pridnestrovskaia Moldavskaia Respublika, the Plenipotentiary on Human Rights in the Pridnestrovskaia Moldavskaia Respublika.

Article 91. Admissibility of Inquiry

The inquiry to the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika to verify the constitutionality of the enactment of the organ of State Government or its individual provisions shall be admissible if the petitioner deems them either unenforceable due to their unconstitutionality or enforceable notwithstanding the official decision of the organs of State Government on the refusal to apply and execute them as not being in conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika.

Article 92. Limits of Verification

The Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall establish the conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika of enactments of State Government as for:
a) substance of the norms;
b) form of the enactment;
c) procedure for their signing, adoption, promulgation, or entry into effect;
d) perspective of the separation of state power into the legislative, executive, and judicial as provided for by the Constitution of the Pridnestrovskaia Moldavskaia Respublika;
e) perspective of the delineation of competence between the organs of State Government as provided for by the Constitution of the Pridnestrovskaia Moldavskaia Respublika;
f) perspective of the delineation of jurisdiction and powers between organs of State Government of the Pridnestrovskaia Moldavskaia Respublika and organs of State Government of Constituent entities of the Pridnestrovskaia Moldavskaia Respublika as provided for by the Constitution of the Pridnestrovskaia Moldavskaia respublika and other agreemnets on the delineation of jurisdiction and powers.
The verification of the constitutionality of the enactments of the organs of State Government that were adopted prior to coming into force of the Constitution of the Pridnestrovskaia Moldavskaia Respublika shall be done by the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika only as for the substance of the norms.

Article 93. Final Decision on Case

Based on the outcome of the consideration of a case on the verification of the constitutionality of an enactment of the organ of State Government the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall pass one of the following decisions:
a) on acknowledgement of the conformity of the enactment or its individual provisions thereof with the Constitution of the Pridnestrovskaia Moldavskaia Respublika;
b) on acknowledgement of the non-conformity of the enactment or its individual provisions thereof with the Constitution of the Pridnestrovskaia Moldavskaia Respublika.
The acknowledgement of non-conformity of the enactment or its individual provisions thereof with the Constitution of the Pridnestrovskaia Moldavskaia Respublika shall make grounds for the abrogation in accordance with the prescribed procedure of the provisions of other enactments, based upon the enactment or the agreement that were acknowledged as unconstitutional, or reproducing it, or containing the same provisions that made up the matter of the petititon. The provisions of these enactments may not be applied by the courts, other bodies and officials.
