CHAPTER 2. POWERS OF THE CONSTITUTIONAL COURT
OF THE PRIDNESTROVSKAIA MOLDAVSKAIA RESPUBLIKA



Article 9. Powers of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika


To ensure the supremacy and direct action of the Constitution of the Pridnestrovskaia Moldavskaia Respublika and to protect the foundations of the constitutional system and the basic rights and freedoms of individuals and citizens on the entire territory of the Pridnestrovskaia Moldavskaia Respublika, the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika:

a) shall pass judgements on conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika:
1) constitutional laws, enactments of the Pridnestrovskaia Moldavskaia Respublika and decisions issued by the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika; enactments issued by the President of the Pridnestrovskaia Moldavskaia Respublika, organs of State Government, local-government of the Pridnestrovskaia Moldavskaia Respublika including settling disputes about competence between organs of State Government;
2) international treaties of the Pridnestrovskaia Moldavskaia Respublika;
3) judicial proceedings;
4) activity of electoral organs and officials of local self-government considering decisions and enactments.

b) based on the outcome of the consideration of the constitutional review shall pass the following decisions:
1) observance of prescribed procedure for charging the President of the Pridnestrovskaia Moldavskaia Respublika with high treason or with commission of other grave offence;
2) international treaties of the Pridnestrovskaia Moldavskaia Respublika that have not come into force, found not to be in conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika;
3) contradiction between the Constitutional Law of the Pridnestrovskaia Moldavskaia Respublika and generally accepted norms and principles of international judicial proceedings;
4) other cases mentioned in the Constitution of the Pridnestrovskaia Moldavskaia Respublika;

c) at complaints on the violation of constitutional rights and freedoms of citizens and at inquiries of courts, verify the constitutionality of a law that has been applied or ought to be applied in a specific case;

d) according to petition of the President of the Pridnestrovskaia Moldavskaia Respublika, the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika, Plenary Sessions of the Supreme Court of the Pridnestrovskaia Moldavskaia Respublika and the Superior Court of Arbitration of the Pridnestrovskaia Moldavskaia Respublika, the Procurator of the Pridnestrovskaia Moldavskaia Respublika, of the Plenipotentiary on Human Rights in the Pridnestrovskaia Moldavskaia Respublika shall settle disputes about constitutionality and shall exercise the constitutional review in cases vested in it by agreements concluded accordance with points a) and b) of the First Part of the Present Article, shall give the interpretation of the Constitution of the Pridnestrovskaia Moldavskaia Respublika and Constitutional Laws of the Pridnestrovskaia Moldavskaia Respublika;

e) shall take legislative initiative on matters within its jurisdiction.

The Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall rule exclusively on matters of law.
In carrying out constitutional judicial proceedings the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall refrain from establishment and investigation of actual facts whenever this falls within competence of other courts or other bodies.

Article 10. Limits of Powers of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The cases on constitutionality of individual (non-standard) enactments of bodies of State Government and local self-government and other cases under court competence within its jurisdiction shall not be considered the powers of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 11. Reasons and Grounds for Consideration of Enactments considered
on non-conformity to the Constitution of the Pridnestrovskaia Moldavskaia Respublika

Based on the outcome of the consideration of a case on the verification of the non-constitutionality of the enactments the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall pass one of the following decisions:
a) on acknowledgement of the non-conformity of the enactment thereof with the Constitution of the Pridnestrovskaia Moldavskaia Respublika;
b) on violation of the procedure for consideration, adoption and taking into force confirmed by the Constitution of the Pridnestrovskaia Moldavskaia Respublika;
c) on going beyond constitutional commissions at their adoption.

Article 12. Obligation of decisions of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The decisions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall be obligatory throughout the territory of the Pridnestrovskaia Moldavskaia Respublika for all representative, executive and judicial organs of State Government, organs of local government, enterprises, agencies, organisations, officials, citizens and other associations.

Article 13. Guarantees of Activity of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall be independent of any other body in organizational, financial, and material and technical terms. Funding of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall be provided for in the republican budget and shall ensure an independent and comprehensive carrying out of the constitutional judicial proceedings. The republican budget shall annually allocate in a separate itemfunds needed to ensure activity of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika that shall be managed by the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika autonomously.
Spending estimates of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika may not be reduced as compared to a preceding financial year.
The Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall autonomously and independently provide for informational and personnel support of its activity.
The property required by the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika to implement its activity and managed by it shall be the federal property.
No restrictions of legal, organizational, financial, informational, material and technical, personnel and other conditions of activity of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, prescribed by the present Constitutional Law, shall be permitted.
