CHAPTER 4. STRUCTURE AND ORGANIZATION OF ACTIVITY
OF THE CONSTITUTIONAL COURT
OF THE PRIDNESTROVSKAIA MOLDAVSKAIA RESPUBLIKA


Article 26. Organisational Forms of the Constitutional Judicial Proceedings

The Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall consider and decide cases in plenary sessions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 27. Questions considered in Plenary Sessions of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall be entitled to consider at the plenary session any question within the competence of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.Exclusively in the plenary sessions the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall:

a) decide cases on conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika:

1) laws (including constitutional laws), enactments of the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika;
2) enactments issued by the President of the Pridnestrovskaia Moldavskaia Respublika, ministries, government departments, organs of local self-government of the Pridnestrovskaia Moldavskaia Respublika, including bodies settling disputes about competence of jurisdiction of organs of different branches of power;
3) international treaties of the Pridnestrovskaia Moldavskaia Respublika;
4) juridical proceedings;
5) activity electoral bodies and officials of local self-government adopting decisions and enactments;

b) deliver advisory opinions:

1) on the observance of a prescribed procedure for charding the President of the Pridnestrovskaia Moldavskaia Respublika with high treason or with commission of other grave offence;
2) on conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika of international treaties of the Pridnestrovskaia Moldavskaia Respublika that have not come into force;
3) on contradiction between the Constitutional Law of the Pridnestrovskaia Moldavskaia Respublika and generally accepted norms and principles of international judicial proceedings;
4) on other cases mentioned in the Constitution of the Pridnestrovskaia Moldavskaia Respublika;

c) at complaints on the violation of constitutional rights and freedoms of citizens and at inquiries of courts, verify the constitutionality of a law that has been applied or ought to be applied in a specific case;

d) shall give the interpretation of the Constitution of the Pridnestrovskaia Moldavskaia Respublika;

e) shall receive messages of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika on conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika;

f) shall take legislative initiative on matters within its jurisdiction.

Exclusively in the plenary sessions the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall:
a) adopt the Rules of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika and make amendments and additions to them;
b) define the sequence of consideration of cases in the plenary sessions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika;
c) decide on suspension or termination of the powers of the Judge of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 28. Procedure for appointment to the office and termination of powers of the
Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika

The Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall be appointed to the office out of the total number of Judges of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika and shall be terminated of powers by the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika after the receipt of the submission of the President of the Pridnestrovskaia Moldavskaia Respublika.
The person shall be considered as appointed to the office of the Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika after the receipt of submission of the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika.
In the event of a Chairman's quitting the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, a submission to appoint another person to fill the vacancy of a Chairman shall be made by the President of the Pridnestrovskaia Moldavskaia Respublika to the Supreme Soviet of the Pridnestrovskaia Moldavskaia Respublika in no event later than one month after the occurence of the vacancy.

Article 29. Procedure for appointment to the office and termination of powers
of Deputy Chairman of the Constitutional Court of the Pridnestrovskaia
Moldavskaia Respublika and Judge-Secretary of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The Deputy Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika and the Judge-Secretary of the Pridnestrovskaia Moldavskaia Respublika shall be appointed to the office out of the total number of Judges of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika and shall be terminated of powers by the Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 30. Early dismissal from the offices of the Chairman of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika, of the Deputy Chairman
of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika
and of the Judge-Secretary
of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika

The Chairman, the Deputy Chairman and the Judge-Secretary of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika may give up their respective powers by the personal application in writing. Such giving up of powers shall be acknowledged by the decision of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.
In the event of the Chairman, the Deputy Chairman and the Judge-Secretary of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika being unable to perform their respective powers are considered to be equal to the Judge of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 31. The Chairman of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall:

a) appoint the Deputy Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika and the Judge-Secretary of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika;
b) define the sequence of consideration of cases in the plenary sessions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika as well as distribute cases between chambers;
c) direct the preparations of the plenary sessions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, convene them, and preside over them;
d) submit for the consideration of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika the questions to be considered at the plenary sessions and sessions of chambers;
e) represent the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika in relations with state bodies and organizations, social associations, and, under the authority of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, issue statements on its behalf;
f) perform general administration of the staff of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, submit for the confirmation by the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika candidates of the heads of the Secretariat and other subdivisions of the staff and other structural units of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika as well as the Regulations of the Secretariat of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika and the list of staff positions;
g) provide for funding of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika in the state budget;
h) exercise other powers in accordance with the present Constitutional Law and the Rules of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.
The Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall issue orders and directives.

Article 32. Temporary Chairmanship of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika

Whenever the Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika is unable to perform his duties they shall be temporarily performed by the Deputy Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.
In the event of the Deputy Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika being unable to perform duties of the Chairman, temporary performance of those duties shall pass, in succession, to the Judge-Secretary of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, the Judge with the seniority of his term as the Judge of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika, and with that being equal to the Judge of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika with the seniority of age.

Article 33. Deputy Chairman of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The Deputy Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall perform those duties of the Chairman of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika which the Chairman may delegate to him as well as perform his own duties which may be entrusted on him by the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 34. Judge-Secretary of the Constitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

The Judge-Secretary of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall:

a) perform direct administration of the staff of the Secretariat of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika;
b) make arrangements for preparation and holding of the sessions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika;
c) bring decisions of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika to the attention of appropriate bodies, organizations and individuals and inform the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika about their execution;
d) make arrangements for the informational support of the Judges of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika;
e) exercise other powers in accordance with the present Constitutional Law and the Rules of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.

Article 35. Rules of the Contitutional Court
of the Pridnestrovskaia Moldavskaia Respublika

In conformity with the Constitution of the Pridnestrovskaia Moldavskaia Respublika and the present Constitutional Law the Rules of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika shall establish: procedure for defining the sequence of considering cases in the plenary sessions; certain rules of procedure and etiquette in the sessions; pecularities of the office in the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika; requirements to be met by the members of the staff of the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika; other questions of internal activityof the Constitutional Court of the Pridnestrovskaia Moldavskaia Respublika.
